Terms and Conditions of Funds Transfer
Please read these terms and conditions carefully. These terms and conditions are an "Agreement" between you and ACLEDA Bank Plc. in relation to the use of funds transfer.
Customer's Responsibility
- You must ensure that all information provided are true and correct.
- In case of changing information, delaying payment, or cancelling funds transfer transaction, please notice to ACLEDA Bank in writing.
- You may check service fee on the ACLEDA Bank's brochures before doing any transactions.
- You are wholly responsible for Cambodia and international law on the funds transfer and guarantee that you are acting on your own and relatives or the settlement under the agreement.
Fund Transfer
- Funds transferred by ACLEDA Bank will be made after the bank approves your transfer application.
- ACLEDA Bank will make payment in accordance with the information specified in the application form, so the bank will not be liable for any costs or losses resulting from insufficient or wrong information given.
- For cancelling funds transfer transaction, ACLEDA Bank will return funds to you after the bank receives them from correspondent bank and the correspondent bank may charge any fees.
- For Fund Transfer transactions to non-account recipient:
- For Fund Transfer transactions to non-account recipient, the transfer amount can be kept in the suspend account in 360 days only. Thus the sender has to contact the recipient to withdraw money timely.
- After receiving inward fund transfer in 360 days without the recipient's present (the recipient has no account), that amount will be delivered to the income account of the ACLEDA, Headquarters, referring to the Decision Letter Nº HQ 1251/09 dated July 27, 2009, the Approval Authorization on Expenses on Customer Service and Public.
- In case of the sender or recipient comes to get fund from 361 period, she/he has to attach with fund transfer documents (for sender) or Q&A or identification document (for recipient) the bank will return fund to the sender or recipient after getting an approval from management.
Type of Currency
- The currency types of fund transfer service to accounts are KHR, USD, THB, EUR, AUD, VND, CAD, JYP, GBP, etc. anyway the fund transfer between accounts with different currencies will be exchanged referring to the bank's prevailing exchange rate once the payment is made into the recipient's account.
- The currency types of fund transfer to non-account recipients are KHR, USD and THB. The fund transfer is made in other currencies, the sender has to convert to be the same as any one of three currency types above and the fund transfer in THB, the recipient can cash out by any or the combination of the two following methods:
- Withdraw cash in KHR or USD that converted from THB referring to bank's prevailing currency exchange rate in case the bank's branch doesn't have enough balance of THB and/or,
- Withdraw cash in THB by requesting of recipient, but recipient is charged fee of foreign currency exchange service of the exchange amount (actual cost was spent by the bank), and wait for receiving THB amount at the scheduled time.
Fees Charge
- Funds transfer fee is set by ACLEDA Bank Plc. You can pay by cash or debiting from your account. You authorize the bank to deduct fee and any expenses from your account.
- Funds transfer fee of ACLEDA Bank, as its discretion, is subject to change without prior notice.
Confidentiality
ACLEDA Bank will not disclose all funds transfer information to any person, except to the following cases:
- ACLEDA Bank requires information for preparing report or other relevant activities required by the law.
- In case of court citation or authority use for investigating or processing any unlawful conduct whether you have involved directly or indirectly.
Anti-money Laundering and Combating the Financing of Terrorism
You agree ACLEDA Bank may postpone, block or stop processing funds transfer if the bank or correspondent bank has found that the process may:
- Directly or indirectly involve the proceeds of unlawful conduct; and
- Breach any national or international law.
Indemnity
- You unconditionally agree to indemnify and compensate the bank against all losses, claims, costs or expense which the bank may incur as a result of processing funds transfer.
- You authorize the bank to debit cash from your account in order to indemnify all claims as mentioned above on the actual situation.
Others
- These terms and conditions are subject to change frequently in order to comply with the Cambodia law.
- These terms and conditions are made in both Khmer and English, so if there is any inconsistency between Khmer and English versions, the terms of Khmer version shall prevail.
- Relevant parties have read, understood, and agreed all points as mentioned in these terms and conditions.
